From the physical beauty of Daniel Crooks’ rhythmic stretching and compacting time and space; Kate Richards’ and Brian Schmidt’s revelations of invisible constellations on the outer reaches of the Southern Heavens; Jess MacNeil’s oscillating video abstractions of swimmers in an ocean pool; to Warwick Thornton’s powerful cinematic depiction of first love framed by red earth and remote desert.

Delving into dynamic digital realms, Anita Fontaine constructs complex constantly shifting video game aesthetics; Troy Innocent generates a neon ecology of signs and symbols; Peter Miller animates intricate microscopic life-forms. The only Dream Worlds constant being permanent change.

Wine Australia will once again present Wine Oasis at the Chicago Jazz Festival in early September at Grant Park.

Now an icon of the Chicago Calendar, the Jazz Festival runs on the Labor Day weekend annually. Wine Australia is presenting its selection of 24 wines that will help people open up to the diversity of Australian wines.

In an interview at the Jazz Festival last year, Wine Australia’s North American Director, James Gosper, said, ‘Australia is regarded as Shiraz territory– so all other varietals and styles are under rated. At the Festival we had extraordinary interest in many alternatives: varietals such as Viogniers, Pinot Noirs, Grenache, Pinot Gris, Roses, sparklings, and some very interesting blends. The objective of asking the consumers to “Open Up” was achieved with great success. One consumer stated that he did not know that Australia produced Pinot Noir, and then proceeded to say he was blown away by the quality the Pinot Noir had to offer.’

Starting or Changing Jobs While in the United States: A Love Story

Setting the scene

You came to the U.S. for a vacation, fell in love and decided to stay. Or you came to the U.S. with an E-3 work visa, fell out of love with your employer and want to change jobs. In either case, the route to pursuing your heart’s desire is not immediately obvious. However, there are a number of options and planning ahead can arrange everyone’s expectations nicely.

You came to the United States as a visitor and decided to stay

As you know, Australians do not need a visa to travel to the United States for up to 90 days under the Visa Waiver Program as either visitors for tourism or visitors for business. While the VWP is a nice convenience, it comes with a downside, which is that you cannot change to a different visa status from inside the U.S. For most other visas (E-3 work visa, F-1 student visas, J-1 exchange visitor visas, B-1/B-2 visitor visas, etc…), U.S. Immigration (USCIS) will let you change status while remaining in the country. As a VWP entrant, however, you must plan to travel outside the country and get the new visa at a U.S. consulate outside the United States.

If you find a job that you would like to accept in the United States and you are in the country under VWP, then you are going to have to prepare the E-3 visa documentation, make an appointment at a consulate outside the U.S. and apply for the E-3 visa abroad. Preparing the E-3 documentation will take approximately two weeks and the lead time for getting an appointment at a U.S. consulate can be anywhere from one week to over a month. As a result, you should prepare your employer for the fact that you will not be able to begin work immediately.

You are working in the United States with an E-3 visa and want to change jobs

If you are already here in the U.S. and working (un)happily and need to change jobs then you have a couple of options from which to choose. You may file a petition for change of employer and extension of E-3 status with the USCIS Vermont Service Center. There are a number of downsides to petitioning for a change of E-3 employer in the United States. First, it takes about 90+ days to accomplish since premium processing is not available for E-3s and you may not begin work with the new employer until the case is approved. By comparison, you could arrange to change your E-3 visa at a U.S. consulate abroad in just a few weeks. Second, it costs $320 to file the petition through USCIS. Third, when you eventually travel internationally in the future you will need to apply for a new E-3 visa at a U.S. consulate abroad anyway before returning to the United States. However, if you are in no rush to begin the new job and you really want to avoid international travel, then changing employers in the U.S. is an attractive option.

The more likely scenario is that you found a new job and your employer expects you to start work immediately. In this case, prepare your employer for the fact that “immediately” by visa issuance standards means about a month. Then you should research appointment availability at consulates in Australia, Canada, the Bahamas or anywhere else that you may want to go. You can prepare your employer for the timing of your start date based upon the availability of appointment dates. You should allow for at least a week from the date of your consular appointment to your projected start date because it takes about three days for most consulates to process the visa and then you have to travel back to the U.S.

If money is no object and you need to start work as soon as possible and you cannot travel internationally for whatever reason, then you may want to consider filing a petition to change status to H-1B with a request for premium processing. An H-1B change of status petition with a request for premium processing can be completed in approximately three to four weeks. Please note, however, that your spouse cannot work as an H-1B dependent as is possible as an E-3 dependent. The technical aspects of preparing such a petition are well beyond the scope of this article and we recommend that you contact an attorney to handle the matter.

You are in the United States on some other visa and wish to accept employment

If you are here as a student (F-1), exchange visitor (J-1) or some other status, you may qualify to change status to E-3 or H-1B status as described above. The process for changing status to E-3 or H-1B is similar in terms of processing times to the process described above for simply changing employers. However, there is an additional issue that you should consider. When you enter the U.S. on a given visa you declare your intent to abide by the terms of that particular visa. For example, if you enter the U.S. with an F-1 student visa then you have probably told U.S. Immigration officials that you intend to study. If you quickly file for a change of status to a work visa then USCIS may find that you misrepresented your intent to be a student when you first entered and therefore that you committed immigration fraud.

USCIS uses the “30/60 rule” to assess whether a misrepresentation may have been made. Under the 30/60 rule, if you indicate an intent to work (i.e., you file to change status to an E-3 visa) within 30 days of entry to the U.S. in a non-work authorized status, then USCIS may presume that a misrepresentation has been made. If you indicate an intent to work between 30 to 60 days of entry then USCIS may presume fraud if other evidence of fraud exists. If you wait for longer than 60 days before indicating an intent to work then (according to this rule) USCIS may not presume fraud. The obvious conclusion to be drawn from all of this is that you should not seek to change status in the United States if you have been here in a non-work authorized status for fewer than 60 days.

Choosing a consulate

You are not required to get your E-3 visa at a U.S. consulate in Australia. U.S. consulates in any country may issue you the visa if you qualify. However, the rules at the consulates vary greatly, so you must check the consulate’s website to determine their policy on issuing visas to third-country nationals (you are a third-country national if you apply anywhere other than in Australia). If this is the first E-3 visa that you have ever received, then there may be advantages to getting the visa at the U.S. consulate with jurisdiction over your Australian residence. The reason for this is that U.S. consulates outside of Australia have less experience authenticating Australian documents, so if there is anything that they do not recognize then the consular officials at the third0-country post may decide to refrain from processing the application. If this happens then you would have return to Australia to apply for the E-3 visa (and would not be allowed to re-enter the U.S. until you accomplish this). Also, note that U.S. consulates in Mexico do not currently issue E-3 visas to people that have never been issued an E-3 visa. The rules at the U.S. consulates around the world are constantly changing so it is essential that you review the rules of the consulate that you intend to visit before making your appointment.

Blue September hits California

When you think of the colour blue, prostate cancer probably isn’t the first thing that springs to mind. But if you come across something pink, like a bow or ribbon, breast cancer quite possibly is. Every year in America, prostate cancer claims just as many lives as breast cancer, but with nowhere near the same fanfare and public sympathy.

Blue September is the campaign dedicated to putting prostate cancer on the agenda and encouraging men to face up to this insidious health threat, highlighting in blue the lack of attention given to a disease that claims the lives of 27,000 American men every year. In 2010, the campaign has teamed together with The Prostate Cancer Research Institute, raising awareness and funds for prostate cancer research and helping men to ‘face up to prostate cancer’.

In this, its inaugural year in California, Blue September is getting the word out about prostate cancer and the need for men to be more aware of the disease and get a checkup, by spreading the spirit of blue all over town. Buildings, landmarks, familiar brands and icons, and most importantly, faces, will be turned blue, encouraging everyone to face up and get proactive about prostate cancer.

While having your face painted blue might not seem like the most comfortable experience in the world, neither is talking about prostate cancer, and yet it can make all the difference. One of the key messages of the campaign is to get people out of their comfort zones, facing up to prostate cancer and getting blue. By taking preventative action towards their health, and making sure to get a check up every few years from 50, men can drastically improve any potential prognosis.

Throughout the month of September some of the prominent buildings and landmarks to be turned blue will include the iconic Capital Records Building, the Ramada Hotel in West Hollywood, Paramount Studios Front Gate and Water Tower, and the historic Roosevelt Hotel. It ties together with an international strategy raising awareness, with buildings in Australia and New Zealand lighting up for the cause, including Australia’s internationally recognized Sydney Harbour Bridge.

There are a series of launches scheduled, including an official Napa Valley Launch event at the exclusive Villagio Spa and Inn and an exclusive garden reception at the Los Angeles Australian Consulate, which will turn blue throughout the evening.

Blue September California has also teamed together with a few key partners who are helping to raise awareness and funds for the campaign. The Oakland Raiders are showing their support for the cause by dedicating their season opener (including selected ticket sales) to Blue September. Messenger Wines are also promoting Blue September by donating proceeds from their biggest selling wine towards The Prostate Cancer Research Institute.

Ultimately, Blue September is about changing attitudes and behaviours towards prostate cancer whilst raising funds for The Prostate Cancer Research Institute. For too long the issue has gone unattended, and it’s time for America to ‘face up to prostate cancer’.

Where did you grow up in Australia?

On a farm outside of Chinchilla, which is on the Darling Downs in Queensland. I also spent my high school years at boarding school in Toowoomba.

What brought you to the US? How long have you been here? How long do you plan to stay?

A company I was working for got involved in the Semantic Web back when it was first announced around 2000. The Semantic Web still doesn't have a strong foothold in Australia, but in Europe and the US it has been growing steadily. After this company closed up shop in Australia, I started getting interest from all over the place for my experience, and I finally accepted a job in Chicago. We were expecting our second child at the time, and my wife insisted that we couldn't move until the baby was born. That made for an interesting move, having a newborn and a not-quite-two-year-old with us!

We've been in the USA for four and a half years now. Initially we thought we'd just stay for the duration of the two year visa, or possibly renew it once. But after two years I was given the chance to work with a non-profit from home, and to get much more involved with the Semantic Web community, so we stayed to do that. Also, my profile in the international Semantic Web community has been increasing, and that wouldn't be possible to the same extent in Australia. So it's hard to imagine moving back right now.

Recently, the organization I was working for ran short of funds, and asked me to look for work elsewhere. At that point I thought we would be moving back, but several exciting opportunities suddenly opened up, and so we are still here.

My first memory of Chicago is...

Catching a cab from Midway to the Loop at night. The lights from the buildings in the Loop reflected orange off low cloud cover that the (then) Sears Tower pierced through. It looked just like some fantasy movie set, and I was stunned to realize that a city really could look like that. It was really cool.

What is your current position/role?

Good question. I'll have to look it up...

Apparently it's "Principal Engineer". Honestly, I don't think anyone in my industry really pays attention to these titles. I've seen some odd and funny ones. My favourite was "Chief Wizard".

What is the best part of your job?

The ongoing recognition that I've received for the work we all did in that little company back in Brisbane. We made that work "open source", and I still work on it now. I've met people from all around the world who use or know this system, and it's quite humbling to realise how big an impact a little Australian company was able to make. It's used in corporations, government and academic institutions, but I particularly enjoyed hearing that people in developing countries were using our work, and are really appreciative that we made it free for them.

It feels really great getting positive feedback from such a diverse international community who appreciate what we've done. It's also really brought home to me the quality of the talent in Brisbane, and Australia in general.

What are the challenges and advantages you face in your industry in the US?

The Semantic Web is about computers making sense of data. The sheer size of the US and its economy means that they have exponentially more data than most other places. This poses a huge challenge in the scale of the problems encountered here in America, but also creates a serious demand for solutions. So it's not easy, but the opportunities are bigger here.

From another perspective, business is a significant part of the culture here in the US - much more than I ever realised. As a result, it is far easier, and indeed expected, for people to turn ideas into a business endeavour.

I've seen successful enterprises here that would never get off the ground in Australia. This can make the US an exciting place to work. A lot of these businesses fail, but that is just seen as a learning experience here, while in Australia it can halt a career.

One negative aspect of this is an excessive need to market. Market the company, market the product, market yourself. I'm really not comfortable with that last one, which has frustrated some of the people I've worked with. It also caused a problem within the Semantic Web industry, as enthusiastic proponents over-promised what could be achieved, ultimately leading to deep skepticism about the value of the Semantic Web. Now that industry and governments understand the system better, the Semantic Web is back on track and growing strongly. I don't believe that these problems existed to this extent in other countries.

If you didn't live in Chicago you'd live in..?

I love the "vibe" of Silicon Valley, since it has drawn so many knowledgable people from around the world. I also love the excitement and opportunities in New York, and the more casual, but still technically advanced atmosphere in Boston.

But our children are at school age now, so we've recently made a move for them. We're out in rural Virginia now, not too far from Washington D.C. It's beautiful here, and there's lot of space for the children, but I find myself pining for Chicago.

What is the one thing you always show to visitors from home?

Until we left Chicago, we always took them into and around the Loop.

There is so much packed into such a small area. There's the Art Institute, the Gromit - oops, I mean Wallace - Tower, and architecture you'll never see anywhere else. We normally walk people from the Merchandise Mart, down to Wallace Tower, past the Picasso in Daly Plaza, to Millenium Park, and then up Michigan Avenue.

Describe Chicago in three words.

Midwestern preeminent metropolis.

Just to explain: I'm not saying that it's preeminent only in the midwest!

It's just that being in the midwest gives Chicago a charm that other major cities don't have.

Is there anything you miss about Australia?

Meat pies, cricket, rugby union, AFL, the Gold and Sunshine Coasts, and especially our family.

Do you plan to return to Australia?

We ask ourselves this question every few weeks. The opportunities are better here, and if we went back then the whole "great adventure" would be over. But we both feel more comfortable there, and I never imagined spending the rest of my career here. In the end it will probably come down to what will be the best move for our children.

Melbourne the new home for $43 billion National Broadband Network

Victoria has secured a major technology investment coup, with the National Operations and Test Facility for the $43 billion Australian National Broadband Network (NBN) to be based in Melbourne.

From this building the NBN Co (the company established to deliver the network) will monitor and manage the NBN network and facilities, order service connections and fault repairs, and allow telecommunications companies using the network to test their services before rollout.

Chief Executive Officer, Mike Quigley, today said up to 425 people would be employed at the new facility when fully operational, with a further 290 staff at the company’s Melbourne CBD head office.

“This facility will be the centrepiece of our network and the key interface with our customers, the retail service providers, who will be using our network to provide high-speed services to their business and residential customers across Australia," he said.

NBN Co has secured approximately 4000m² of office space in Melbourne’s innovation heartland – the Digital Harbour development in Melbourne’s Docklands – for the fit-out of its state-of-the-art operations centre and testing facilities. NBN Co will soon be issuing a tender for this work.

Victorian Premier John Brumby said the decision to locate the facility in Melbourne demonstrates Victoria’s role as the “nation’s technology hub”.

“NBN Co’s choice to base the Network Services Operations Centre in Melbourne is a clear affirmation of Victoria’s expertise in the telecommunications and technology sectors,” he said.

“This will be the nerve centre operating the roll out of the $43 billion national network over the next eight years.”

Victoria is home to Australia’s highest proportion of skilled ICT workers in Australia – employing around 87,000 people including 22,000 in the telecommunications sub-sector.

Daily commute in Melbourne envy of the world

Melbourne has emerged as the second best city in the world in which to drive to work in a global IBM study, which ranked 20 cities from around the world according to their ‘commuter pain’.

IBM’s first Commuter Pain Index places Melbourne second only to Stockholm on issues ranging from commuting time, time stuck in traffic, stress and anger caused by driving and traffic affecting work performance.

The index, which surveyed over 8,000 motorists in 20 cities on six continents, revealed that a quarter of Melbourne drivers say they have never been stuck in traffic in the last three years, despite 91 per cent of Melburnians opting to drive to work.

IBM found that the daily commute in some of the world's most economically important international cities is longer and more grueling than before imagined, reflecting the failure of transportation infrastructure to keep pace with economic activity, however Melbourne has come out among the best in the world with one-third of all Melbourne driving commuters also saying they do not experience any traffic stress.

The longest that drivers in Melbourne said they had been stuck in traffic, over the past three years, was 27 minutes - the shortest of any world city.

The IBM index further enhances Melbourne’s reputation as a great place to live and work, following its top ten ranking in Monocle’s annual Quality of Life Index earlier this month.
